Terms and Conditions
Please read the following terms and conditions carefully before making a booking with Team Rich TV, a video production company. These terms and conditions outline the rights, responsibilities, and obligations of both the client and Team Rich TV. By making a booking, you agree to adhere to these terms and conditions.
1. Booking and Confirmation:
1.1. All bookings must be made in the form of written confirmation via Email, Text, Direct Message, or through the Team Rich TV website.
1.2. A booking is considered confirmed only upon receipt of a written confirmation from Team Rich TV stating that a deposit has been accepted from the client.
1.3. Booking confirmation will specify the agreed-upon details, including the dates, services, and pricing.
2. Services:
2.1. Team Rich TV will provide video production services as agreed upon in the booking confirmation.
2.2. Any changes or additions to the agreed-upon services must be made in writing and confirmed by both parties. Additional fees may apply.
2.3. Team Rich TV reserves the right to subcontract any part of the agreed services to a third party, without prior notice to the client.
3. Pricing and Payment:
3.1. The pricing for video production services will be specified in the written booking confirmation, and may include taxes and/or fees.
3.2. Unless otherwise agreed upon, payment terms are as follows:
3.2.1. If the total booking price is $151 or above then a deposit of half the total booking price is due immediately to confirm the client's booking date. Failure to pay a deposit in a timely manner may result in specific dates becoming unavailable.
3.2.2. The remaining balance is due before filming begins on the day of the video production project.
3.2.3. If the total booking price is $150 or less then the total payment is due immediately to confirm the client's booking date. In this case, the total payment is treated as a deposit and is subject to forfeiture in certain circumstances as outlined in the following terms.
3.3. Failure to pay the remaining balance at the agreed upon time will result in an immediate forfeiture of the deposit.
3.4. All prices quoted are exclusive of any applicable taxes, fees, or expenses, unless otherwise stated.
4. Cancellation and Rescheduling:
4.1. Cancellation or rescheduling requests must be made in writing and acknowledged by Team Rich TV.
4.2. In the event of cancellation:
4.2.1. All deposits are non-refundable. There will be no refunds of deposits based upon the client misunderstanding these booking terms, the client not having enough money to pay the remaining balance, or for any other reason (regardless of perceived fault). This also applies to full payments when the total booking price is $150 or less.
4.2.2. If cancellation occurs within a specified period before the scheduled start date, the client may be liable for additional fees or charges.
4.3. In the event of rescheduling:
4.3.1. Team Rich TV will make reasonable efforts to accommodate rescheduling requests, subject to availability.
4.3.2. Additional fees or charges may apply when productions are rescheduled.
5. Editing and Final Delivery:
5.1. The editing process will begin promptly after the videoshoot is completed.
5.2. The completely edited deliverables will be delivered to the client within the timeframe stated on the booking confirmation:
5.2.1. Any and all additional deliverables requested by the client during the editing process, should the request be accepted by Team Rich TV, will incur inconvenience fees that range from $75 to $1500 dependent upon the difficulty of the request and severity of the inconvenience.
5.2.2. Requesting additional deliverables may prolong the editing process for an extensive period of time due to other clients that may also have productions within the editing phase.
5.3. The editing process may be expedited with payment of a rush fee that ranges from $250 to $1500 dependent upon the requested completion date, amount of other clients who also have productions within the editing phase, the difficulty of the request, and the severity of the inconvenience.
5.3.1. Team Rich TV is not obligated to accept any requests to expedite the editing process. If a rush fee is accepted there is still no absolute guarantee that the edit will be completed at the exact date requested by the client. Upon acceptance of a rush fee, Team Rich TV will stop working on all non-expedited edits until the requesting client's production is completely edited. Regardless of the completion date of an expedited edit there will be no refunds on rush fees.
6. Ownership and Usage Rights:
6.1. Final video production deliverables will be sent to the client. The client has the right to distribute the video production however they desire, but is subject to the usage rights specified in the written confirmation.
6.2. Team Rich TV retains the right to use the completed video production in it's entirety, or in excerpt format, for any purpose, unless otherwise agreed upon in writing.
7. Confidentiality:
7.1. Both the client and Team Rich TV agree to treat any confidential information disclosed during the video production process as strictly confidential.
7.2. Confidential information may not be disclosed to any third party without prior written consent from the disclosing party. Confidential information may include, but is not limited to; Booking locations, equipment used, payment amounts transfered, names of third-parties hired, etc.
8. Limitation of Liability:
8.1. Team Rich TV will make reasonable efforts to ensure the quality and timely delivery of services, but cannot be held liable for any unforeseen delays, technical issues, or events beyond its control.
8.2. Team Rich TV has no liability for any damages, whether direct or indirect, arising from its services and no amount paid by the client will be refunded due to any damages incurred.
8.3. The client accepts full responsibility for any damages to property that occurs during the filming process. The client remains liable for all damages regardless of the attending persons at fault for causing the damages. All property utilized for video production is to be handled, operated, or otherwise used with the utmost care to avoid unnecessary damage fees, fines, or lawsuits being leveed against the client.
8.4. No refund will be issued based upon the client's, or their affiliate's, dissatisfaction with the services provided by, or the final product received from, Team Rich TV.
9. Governing Law and Jurisdiction:
9.1. These terms and conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which Team Rich TV is located.
9.2. Any disputes arising from these terms and conditions shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
By making a booking with Team Rich TV, you acknowledge that you have read, understood, and agreed to these terms and conditions.
